Motor Vehicle Accidents( Road Accident Fund)

If you are involved in a motor vehicle accident and you are not to be blamed or are partially responsible for the accident then you have automatic insurance for your damages incurred in the accident against the Road Accident Fund.

Every time you fill your car with petrol or diesel you pay a levy to the Road Accident Fund which approximates R25 per tank! The Road Accident Fund is thus by law substituted as the common law wrongdoer and you can claim damages from the Road Accident Fund.

You have to satisfy two requirements, you have to have been injured and you must not have been the sole cause of the accident. No claim is too big or too small for our firm. Medical Negligence

These are claims against medical doctors/experts who operate in a negligent manner. Medical malpractice cases include brain defects, brain damage suffered during the birthing process resulting in asphyxia and or loss of fetus.

Unlawful Arrest and Detention

Although private individuals (citizens) may make an arrest, such is normally the duty of police officers authorized thereto by virtue of their office. Police officers normally make arrests after having obtained a warrant authorizing them to do so. It is however not the only way that police officers may make arrests. Police officers are also authorized to make an arrest without a warrant by Section 40(1) of the Criminal Procedure Act 51 of 1977 which will be the focus of this article.

In summary, Section 40(1) authorizes police officers to make an arrest in cases wherein they reasonably suspect someone has committed an offence specified in Schedule 1 of the Criminal Procedure Act and crimes that are committed in their presence. The list of offences that police officers may make arrests for is lengthy for the purposes of this article. However, it is important to note that, in most of the listed offences (i.e murder, rape, kidnapping, public violence etc), the police officer must have a reasonable suspicion that the offence was committed.

A claim of unlawful arrest is normally accompanied by a claim for unlawful detention coupled with a claim for pain and suffering as a result of assault where applicable. We have a department that deals with the claims of Unlawful arrest and detention

Train Accidents

These are claims for personal injury or loss of support claims originating while being transported by a train or even while getting on or off a train We handle all claims involving Metrorail, Transnet or the Passenger Rail Agency of South Africa (PRASA).

Slip and Trip Injuries

These injuries usually occur as a result of people slipping or falling due to a design flaw on a walkway surface, or even slippery surfaces caused by the fault of the owner of the property.
